HOW TO ORDER:
1. CHOOSE THE DESIGN(S) you wish to license, and put them in your cart. ***They must be purchased in this order or a previous order. Future design purchases may not be applied to this licensing order.*** One design per license.
2. CHOOSE THE CATEGORY you wish to License the designs in (examples include: Apparel, Home Decor, Stationary).*Please message me if you don’t see your category.
3. CHOOSE THE NUMBER OF LICENSES (based on the number of Designs from this order you wish to license) from the dropdown menu. *If you need licensing for up to 5 designs, see this listing.
4. In the “Notes” box at checkout, PLEASE LIST WHICH DESIGNS from your order that you’re licensing - especially if you’re also buying designs you only want for personal use.
5. MAKE YOUR PAYMENT, and download the designs!
6. SIGN and return the License Document when it's sent to you via email.

This listing is for individual designs (to be purchased along with this listing) for commercial use. One design per License. ***All designs you wish to license must purchased on the same calendar day or prior to the date of the licensing purchase.*** If you have purchased designs in the past, and now wish to license those designs, please contact us with your order number so we can verify your past purchase. Purchasing commercial licensing with the intent to apply it to future design purchases is not permitted.

Some of our designs are not available for commercial licensing, so please inquire if you're unsure. We are in the process of updating all listings to reflect which ones are available for commercial use. Most will be available, so please ask! We reserve the right to deny licensing if deemed appropriate.

General Terms include, but are not limited to:
You MUST:
• Provide adequate protections against copying of the graphic design images. You must watermark the designs so that they cannot be traced by computer software. This may disqualify you from selling items using our designs on certain websites.
You May:
• Use your design, which must be purchased separately, for use up to 100 times on products such as coffee mugs, t-shirts, blankets, in scrapbooks, and on cards. You must credit The Smudge Factory™ somewhere in your listing. Such products may be sold on Etsy.
• You may use our designs as a graphic overlay on personalized greeting cards
You May NOT:
• Create items for sale on Etsy that compete with The Smudge Factory™'s products on Etsy, such as printable/printed art, even if you add a background to the art. Printed transfers are not allowed. You may, however, sell printable/printed wall art in a physical store location as stated above;
• Alter our designs in any way, shape or form and claim them as your own, however, color changes are allowed;
• Cut our designs apart and piece them together to create new designs;
• Sell our art in digital files, even if you add a background;
• Gift, share, or sell the digital files through email, USB, disc, or any other way;
• Use them on website pages without protecting the image from being copied;
• Upload our files to any file sharing websites for any reason;
• Use our designs on products being sold on a Flash Sale website (please ask for details);
• Use or upload our designs to a Print on Demand website;
• Use our designs for any harmful, pornographic, racial or offensive material;
• Use our designs to create you own products which will compete with The Smudge Factory™ or our other products;
• Copy or create items that look very similar to our designs;
• Use our designs to create and sell stencils or any type of stamps;
• Sell our designs as a wholesaler, or sell items using our designs to other companies to sell;
• Use this license if your company consists of more than 10 employees. Companies with more than 10 employees require a different license. Please inquire.
Official terms will be emailed within 48 hours of purchase as long as files are purchased long with the licensing, and must be signed and sent back within 48 hours of receipt before licensing is valid. If the licensing agreement is not returned within 48 hours, we reserve the right to refund your purchase of the commercial license, or cease your license. Please ensure that your email address is correct when purchasing.
